Terms and Conditions

Once instructed to carry out an Appointment, acceptance of the ‘Terms’ provided by PROPRT360 is deemed to be an acceptance of our published fees and the following Terms & Conditions:

The ‘Staffer’ means the person(s) appointed by PROPRT360 to inspect the Property for the purpose of preparing the Document(s).

The ‘Property’ means the venue, house, flat or other residential dwelling or business premises; the condition and contents of which are recorded in the Document(s).

The ‘’Booker’ means the person(s) who booked the Appointment and their company.

The ‘Document(s)’ means the Inventory & Building Condition Report, Interim / Mid-term Inspection, Check-out / End-of-Tenancy Report, Legionella Risk Assessment, Domestic 2D Floor Plans, Virtual 360º Tour, Digital Voice Recordings, Video Footage, High Quality Photographs and any other services we may provide, in accordance with the following conditions:

a) Upon receipt of a pre-booked Appointment, the Staffer will undertake the inspection of the Property for the purposes of compiling the Document(s).

b) The Inventory & Building Condition Report will consist of a list of fixtures, fittings and household effects, along with the description of the state of decoration and condition of the interior of the Property. Items may be identified by original name of manufacturer, colour and serial/model number where accessible.

c) The Inventory & Building Condition Report, Interim / Mid-term Inspection / Check-out / End-of-Tenancy Report does not at any time claim to be a report for valuation purposes of the Property and/or its contents, nor is it a guarantee of, the adequacy of, or safety of, any equipment or contents. It is a record that such items exist within the Property and their superficial appearance at the time the Document(s) was produced.

d) The Inventory & Building Condition Report will be compiled on the basis that unless stated otherwise, items recorded are in good condition, free from obvious soiling, damages or defects.

e) The Inventory & Building Condition Report, Interim / Mid-term Inspection / Check-out / End-of-Tenancy Report: Electrical items will be tested for power-on only if accessible and/or appropriate, unless the Staffer deems testing unsafe. Items must be complete with plug, flexes and bulbs, unless otherwise ascertained. Power to the Property at the time of inspection is the responsibility of the Landlord and/or Letting/Management Agent.

f) The Inventory & Building Condition Report, Interim / Mid-term Inspection / Check-out / End-of-Tenancy Report: Mattresses will be inspected where accessible, turned and both sides recorded, unless the bed is made-up. Staffers do not remove linen or bedding from beds, nor do they re-make beds for the purposes of our Appointments.

g) The Inventory & Building Condition Report, Interim / Mid-term Inspection / Check-out / End-of-Tenancy Report: Flooring, floor coverings, rugs, carpets and furniture will be inspected to the extent that they are sufficiently clean so that burns, stains and other damages can be ascertained. If the Property is especially dirty during a Check-out/End-of-Tenancy Appointment; the Staffer may not be held responsible for the omission of burns, stains and other damages which are hidden by debris, dirt or discarded belongings/rubbish. Staffers do not clean areas of the Property that are dirty, nor do they remove or dispose of discarded belongings/rubbish.

h) The Document(s) will be compiled by the Staffer assuming they are able to do so without moving any fixtures, fittings or large/heavy items that the Staffer is unable to, or that is considered to be fragile or unsafe to do so.

i) The Check-out / End-of-Tenancy Report: At the end of a tenancy, receipts may be required and requested for items or areas of the Property that have been professionally cleaned.

j) The Inventory & Building Condition Report, Interim / Mid-term Inspection / Check-out / End-of-Tenancy Report: Smoke detectors, carbon monoxide detectors and intruder detection systems may be noted within the report but may not be tested and remain the sole responsibility of Booker.

k) PROPRT360 reserves the right to withdraw its services if it is deemed the number of short-notice cancellations by the Booker become excessive or unmanageable. Upcoming appointments will be cancelled with a 24 hour notice period.

l) PROPRT360 reserves the right to increase the prices for services offered, both for standard and prepay Clients. The latest prices for services offered are available on our website and should be confirmed and accepted as part of these terms of service. Payment of all invoices should be made within 14 days of issue, unless agreed with the Booker prior to any service being carried out. Failure to adhere to this may result in PROPRT360 refusing further instructions until outstanding balances are cleared. A 5% late payment fee of the invoice amount will be added for each 28 day period it passes issue date.

m) Payment for services provided by PROPRT360 can be made by bank transfer or debit/credit card; details of which are enclosed on each invoice.

n) Where a nominated person is to be met by the Staffer at the Property – unless direct confirmation is made between the Staffer and the nominated person (either by telephone, text message or email) to confirm the Appointment date/time – the Appointment will be cancelled the day before and the Staffer will not attend. Confirmation from the Booker that the nominated person will be at the Property at the date/time is not sufficient. This helps us to avoid invoicing Bookers for cancelled or aborted Appointments. When the Appointment is cancelled, the Booker will be advised to re-book once keys are back in their possession.

o) Where an Appointment has to be cancelled or aborted with less than 3 hours-notice, or where the Staffer attends the key collection address or the Property in person, a £30 standard Appointment cancellation/abortion fee will be invoiced. There will be no Appointment cancellation/abortion fee if the Staffer is notified of the cancellation/aborted Appointment by phone, email or using the online booking system cancellation service 3 hours or more prior to the Appointment start time.

p) If the travel distance between your booking and the previous or following booking is lengthy; we reserve the right to reschedule the time of the Appointment. We will contact you as soon as possible if this is the case.

q) If the Booker books several Appointments for the same day and the times chosen are not consecutive, we reserve the right to reschedule the time to make them consecutive or cancel one or more Appointments.

r) The Check-out / End-of-Tenancy Report: Due to a history of being issued Inventory & Building Condition Reports produced by other providers, we have found them to be lacking, unprofessional and somewhat unreliable. Therefore, we reserve the right to decline Check-out / End-of-Tenancy Appointments unless we produced the initial Inventory & Building Condition Report by which we are able to make sound comparisons of the condition of the Property.

s) Private landlords, ad-hoc Appointments and potential new Bookers are required to pre-pay for their Appointments. This means if payment is not received before 24 hours of the chosen Appointment time; the Appointment will be cancelled. An automated email confirmation will be issued to the booker’s email address.

t) Long-term Bookers have opted to pre-pay for our services to save money when compared with our standard pricing. This option is now available to all Bookers. Pre-pay Bookers receive an invoice for £1,800 prior to any Appointments being carried-out. Once the invoice is paid in full, an online statement of account is created which lists the date and reduced price of subsequently booked Appointments as they are completed. Like a typical bank statement, the balance reduces as Appointments are completed. Once the balance reaches £150 or less, a new invoice is issued to ensure the account does not fall into arrears; this invoice is required to be paid forthwith.

u) The Inventory & Building Condition Report, Interim / Mid-term Inspection / Check-out / End-of-Tenancy Report: Our Staffers will not ‘dress’, tidy or rearrange the contents of the Property for the purposes of producing the Document(s). The condition and contents of the Property will be recorded as they are found. This means rubbish, broken furniture and if landlord or previous tenant belongings are present, they will be recorded within the Document(s). If the Property is deemed ‘not ready’ by the Staffer in order to be able to produce the Document(s), the Staffer will endeavour to contact the Booker to clarify what course of action to take, ie: produce the Document(s) as-seen, rearrange the Appointment or cancel until further notice.

v) The Virtual 360º Tour Appointment: Our Staffers will record the Property as found at the time of the Appointment. It is the sole responsibility of the Booker to ensure the Property is presentable for recording. For example, we will not move furniture, tidy rooms or clean areas that may require it. We may however open curtains/blinds to ensure the correct amount of light is used as well as closing toilet seats to give a more professional view.

w) Virtual Reality 360º Tours: Due to the cost incurred in hosting Virtual Reality 360º Tours, each initial purchase will last for 365 days and your tour will remain online and active during this time. Unless agreed/arranged before the expiry date; by means of an additional annual hosting charge of £2 per property per year, your tour will be deleted from the server and archived. Once your tour has been deleted from the server and archived, you will have the option to retrieve and restore it from our archives for a surcharge or simply book a new Virtual 360º Tour Appointment.

Disclaimer

The Document(s) prepared are an ‘as-seen’ snapshot of the Property and its contents on the date and time of the inspection and compiled as an independent, impartial and fair record of the cosmetic condition of the Property; it should not be used as an accurate description of each and every piece of furniture, equipment, decoration or standard of cleaning, or as a structural survey report.

Therefore, as the Staffer is not an expert on fabrics, woods, materials or antiques etc; nor is a qualified surveyor or valuer, they are not required to state whether an item is antique, made of precious metals, of unique origin or whether it is brand new, despite its appearance.

Any items left in loft spaces, cellars or in locked rooms, garages, garden sheds or outbuildings that have not been noted in the Document(s) remain the sole responsibility of the Booker. The movement of large/heavy items will not be undertaken and therefore some observations may be restricted where such items restrict full-view.

Document(s) produced with the Tenant(s) present and it is deemed difficult by the Staffer to differentiate between items belonging to the Vendor, Landlord or Tenant(s), the Document(s) may contain inaccuracies for which the Staffer may not be held responsible. The Document(s) relates only to furniture, furnishings and Landlord equipment and contents within the Property. It is no guarantee of, or safety of, any such equipment or contents, merely a record that such items exist within the Property on the date the Document(s) is produced.

The Inventory & Building Condition Report, Interim / Mid-term Inspection / Check-out / End-of-Tenancy Report: No appliances will be tested to confirm working order. It is most important that all cleaning is completed prior to the Appointment and any obvious or significant discrepancies are reported to the Landlord and/or Letting/Management Agent.

The Document(s) produced and any photographs included within it provide a fair and accurate record of the condition and contents of the Property as the professional, independent and impartial opinion of the Staffer on the date it is produced. However, it is the sole responsibility of Booker to check, verify and agree the accuracy of the Document(s) prior to any action being taken.
